AXA Plus Terms and Conditions of Use

These Terms and Conditions apply to the use of the AXA Plus services, including the websites www.axa.ie/axaplus and www.axani.co.uk/axaplus (referred to collectively herein as the “Site”), the e-newsletter and the AXA Plus loyalty card (the “AXA Plus Services”), which are owned and operated by AXA Insurance dac (“AXA Ireland”).

Eligibility Requirements

The AXA Plus Services are provided for the personal use of AXA Ireland policyholders in the Republic of Ireland and Northern Ireland and must not be used by you for any commercial, illegal or unauthorised purpose whatsoever.

To avail of the AXA Plus Services, you must have a current car, commercial vehicle, taxi or home insurance policy.

Companies that are affiliated with AXA Plus (our ‘Partners’) may seek proof of eligibility to provide you with a special offer or service. In some circumstances AXA Ireland may also be required to provide Partners with confirmation of eligibility. Proof of eligibility may include sight of your Insurance documents and/or AXA Plus card (AXA Plus cards are only part of the ROI system and are not needed by NI customers).

AXA Plus e-newsletter

You can opt out of receiving the AXA Plus e-newsletter at any time by going to www.axa.ie/axaplus or www.axani.co.uk/axaplus and clicking the unsubscribe link at the bottom of the page or by clicking on the unsubscribe link in every e-newsletter.

Obligations of Partners

Any contract which is concluded between you and a Partner participating in the AXA Plus loyalty programme is between you and that Partner.

We understand there may be times when you do not receive the service you expect. Where this may be the case we invite you to contact both the Partner and ourselves. This will assist us in selecting appropriate Partners for the AXA Plus Services. This can be done by clicking here.

User Submissions

Any communication you send or transmit to AXA Ireland in relation to the AXA Plus Services, whether via post, email, the Site or any other means whatsoever, shall be treated as non-proprietary.

Commercial exploitation of the Site is strictly prohibited

AXA Ireland reserves the right to prevent further access by you to the Site for violating these Terms and Conditions, or use of the Site or transmission or posting communications to the Site, which AXA Ireland deems to be in breach of these Terms and Conditions.

Users of the Site agree not to:

  1. use the Site in any unlawful manner or in a manner which promotes or encourages illegal activity; or
  2. attempt to gain unauthorised access to the AXA Plus Services or any networks, servers or computer systems connected to the Site; or
  3. modify, adapt or reverse engineer any part of the Site or re-format or frame any portion of the pages comprising the Site, save to the extent expressly permitted by these Terms and Conditions or by law; or
  4. submit any offensive or defamatory messages, comments or material to AXA Ireland.

Intellectual Property

The copyright in all material contained on, in, or available through the Site and the e-newsletter including (without limitation) all information, data, text and graphics, the selection and arrangement thereof, and all source code, software compilations and other material ("Material") is owned by or licensed to AXA Ireland or its group companies, Partners and service providers. All rights are reserved. You cannot copy, edit, vary, reproduce, publish, display, distribute, store, transmit, commercially exploit, disseminate in any form whatsoever or use the Material or any part thereof without prior written permission.

Disclaimer / Liability

USE OF THE AXA PLUS SERVICES, INCLUDING (WITHOUT LIMITATION) THE SITE, IS AT YOUR OWN RISK. THE AXA PLUS SERVICES, INCLUDING (WITHOUT LIMITATION) THE SITE, ARE PROVIDED ON AN "AS IS" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) AXA IRELAND DISCLAIMS ALL LIABILITY WHATSOEVER, WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE IN RELATION TO THE AXA PLUS SERVICES, INCLUDING (WITHOUT LIMITATION) THE SITE; AND (B) ALL IMPLIED WARRANTIES, TERMS AND CONDITIONS, INCLUDING (WITHOUT LIMITATION) ANY WARRANTY, TERM OR CONDITION AS TO ACCURACY, COMPLETENESS, SATISFACTORY QUALITY, PERFORMANCE, FITNESS FOR PURPOSE OR ANY SPECIAL PURPOSE, AVAILABILITY, NON-INFRINGEMENT, INFORMATION ACCURACY, INTEROPERABILITY, QUIET ENJOYMENT AND TITLE, RELATING TO THE AXA PLUS SERVICES, INCLUDING (WITHOUT LIMITATION) THE SITE, WHETHER IMPLIED BY STATUE, COMMON LAW OR OTHERWISE ARE, AS BETWEEN AXA IRELAND AND THE USERS OF THE AXA PLUS SERVICES, INCLUDING (WITHOUT LIMITATION) THE SITE, HEREBY EXCLUDED. IN PARTICULAR, BUT WITHOUT PREJUDICE TO THE FOREGOING, AXA IRELAND ACCEPTS NO RESPONSIBILITY FOR ANY TECHNICAL FAILURE OF THE AXA PLUS SERVICES, INCLUDING (WITHOUT LIMITATION) THE SITE; OR ANY DAMAGE OR INJURY TO USERS OR THEIR EQUIPMENT AS A RESULT OF OR RELATING TO THEIR USE OF THE AXA PLUS SERVICES, INCLUDING (WITHOUT LIMITATION) THE SITE.

AXA IRELAND ACCEPTS NO LIABILITY OR RESPONSIBILITY FOR TECHNICAL ERRORS OR COMMUNICATION FAILURES IN NETWORKS AND/OR INTERNET ACCESS.

AXA IRELAND DOES NOT MAKE ANY REPRESENTATION THAT THE GOODS AND/OR SERVICES OR PARTNERS ADVERTISED ON THE SITE OR THE E-NEWSLETTER ARE APPROPRIATE OR SUITABLE FOR USE OR THAT THEY COMPLY WITH THE LEGAL OR REGULATORY REQUIREMENTS OF ANY LOCATION.

EACH USER OF THE AXA PLUS SERVICES, INCLUDING (WITHOUT LIMITATION) THE SITE, AGREES TO INDEMNIFY AXA IRELAND AND ITS GROUP COMPANIES IN FULL AND ON DEMAND FROM AND AGAINST ANY LOSS, DAMAGE, COSTS OR EXPENSES WHICH THEY SUFFER OR INCUR DIRECTLY OR INDIRECTLY AS A RESULT OF THE USER’S USE OF THE AXA PLUS SERVICES, INCLUDING (WITHOUT LIMITATION) THE SITE, OTHERWISE THAN IN ACCORDANCE WITH APPLICABLE LAWS.

Miscellaneous

When you use the AXA Plus Services you must comply with all applicable Irish laws and with any applicable local laws in your jurisdiction, if different (together referred to as "Applicable Laws").

Access to the Site from locations where the contents of the Materials or the services or goods advertised on the Site are illegal is prohibited.

The AXA Plus card remains the property of AXA Ireland.

The AXA Plus card is non-transferable and only valid for the person named on it.

These Terms and Conditions shall be governed by and construed in accordance with the laws of Ireland and the Irish courts shall have exclusive jurisdiction for the purpose of any proceedings arising out of or in connection with the AXA Plus Services or the Materials.

If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect.

No waiver of any term or condition of these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or any other term or condition.

Changes

AXA Ireland may at any time, without liability, modify, suspend or discontinue the AXA Plus Services, including (without limitation) the Site, these Terms and Conditions and/or the goods and services advertised in the AXA Plus e-newsletter and/or on the Site or any part thereof, with or without notice for any reason whatsoever. By using the Site, you agree to be bound by any such changes. You should visit this Site from time to time to determine the terms and conditions by which you are bound.
